Section 1980. Definitions

7 AAC 43.1980. Definitions

In 7 AAC 43.1900 - 7 AAC 43.1980,

(1) "capped rental" means the rental of durable medical equipment, prosthetics, or orthotics for no more than 12 months;

(2) "CMS" means the United States Department of Health and Human Services, Centers for Medicare and Medicaid Services;

(3) "customized durable medical equipment" means durable medical equipment that is uniquely constructed or substantially modified for a specific recipient according to the description and orders of a physician, physician assistant, or advanced nurse practitioner, and that is so different from another item used for the same purpose that the two items cannot be grouped together for pricing purposes;

(4) "durable medical equipment" means equipment that

(A) can withstand repeated use;

(B) is primarily and customarily used to serve a medical purpose;

(C) generally is not useful to an individual in the absence of an illness or injury; and

(D) is appropriate for use in the home, school, or community;

(5) "medical supplies" means supplies that

(A) do not withstand repeated use;

(B) are primarily and customarily used to serve a medical purpose;

(C) generally are not useful to an individual in the absence of an illness or injury; and

(D) are appropriate for use in the home, school, or community;

(6) "miscellaneous" means an item or service listed in Healthcare Common Procedure Coding System (HCPCS) 2005, as amended from time to time and adopted by reference in 7 AAC 43.1910, that is

(A) described as "miscellaneous," "not otherwise classified," or "not otherwise specified"; or

(B) without a specific description or identifier.

(7) "national drug code" means the code assigned by the United States Food and Drug Administration under 21 C.F.R. Part 207 (Registration of Producers of Drugs and Listing of Drugs in Commercial Distribution);

(8) "rental period" means the number of rental units authorized by the department;

(9) "rental unit" means one day for anticipated short-term rental, and one 30-day period for anticipated long-term or continuous use.
