Section 125. Waiver of requirements

7 AAC 13.125. Waiver of requirements

(a) The commissioner of the department will, in his or her discretion, waive a requirement of 7 AAC 13 if a facility establishes an alternative method of satisfying the requirement.

(b) The governing board of a facility shall apply for waiver in writing to the department. The application must include

(1) a statement of the requirement for which a waiver is requested;

(2) an explanation of the reasons why the requirement cannot be satisfied; and

(3) a description of the alternative method proposed to satisfy the requirement for which the waiver is requested.

(c) The department will reply in writing to all requests for waivers within 30 days after receipt. The department will grant or deny a waiver, or will request that the governing board take some further action while the department defers further consideration of the application until that action is taken.
