Section 435. Motions

6 AAC 30.435. Motions

(a) Before the hearing, parties may only file the following written motions with the hearing examiner:

(1) to remove a hearing examiner due to a conflict or the appearance of partiality;

(2) to dismiss for lack of jurisdiction;

(3) to amend the complaint or answer;

(4) to change venue;

(5) to consolidate;

(6) to facilitate discovery;

(7) in limine; and

(8) to certify a class under 6 AAC 30.420.

(b) Except as provided in (a) of this section, motion must be presented at hearing and stated orally on the record. The hearing commissioners will not review hearing orders of the examiner until the examiner submits a recommended decision under 6 AAC 30.470.
