Section 650. Permanent absentee voter

6 AAC 25.650. Permanent absentee voter

(a) The election supervisor may designate a person as a permanent absentee voter if the person is a qualified voter under AS 15.05.010 , and if the

(1) election supervisor determines that the voter resides in a remote area in Alaska where distance, terrain, or other natural conditions deny the voter reasonable access to the polling place;

(2) voter has identified an institution in the state serving the aged, disabled, or handicapped as a permanent residence on his or her current registration record; or,

(3) voter is disabled voter and has requested to be designated a permanent absentee voter.

(b) A person designated as a permanent absentee voter under (a) of this section will be sent an application for an absentee by-mail ballot at the permanent mailing address stated on the voter's current registration record on the following schedule:

(1) even-numbered years; in May, to every permanent absentee voter on the statewide registration rolls;

(2) odd-numbered years; in May, to every permanent absentee voter located in an area that will be voting in a regional educational attendance area or coastal resource service area election;

(3) at least 45 days before a special election in any calendar year that is not a by-mail election; and

(4) at a time specified by the director or an election supervisor before any election, to voters defined in (a) of this section who registered to vote after the last mailing of absentee by-mail ballot applications.

(c) The voter may submit the application and vote by mail under AS 15.20.081 . However, nothing in this section limits the voter's eligibility to vote in person at a precinct under AS 15.15.195 or 15.15.198, in person before an absentee voting official under AS 15.20.061 , or absentee through a personal representative under AS 15.20.071 .
