Section 30. Methods, means, and general provisions - Finfish

5 AAC 61.030. Methods, means, and general provisions - Finfish

(a) Unless otherwise specified in 5 AAC 61.022 or by an emergency order issued under AS 16.05.060 , the provisions of this section apply to finfish sport fishing in the Susitna - West Cook Inlet Area.

(b) Unless otherwise specified in this section or in 5 AAC 75, fish may be taken only by hook-and-line gear.

(c) Repealed 6/11/2005.

(d) Except as specified in 5 AAC 61.022, all waters of the Susitna - West Cook Inlet Area are closed to fishing for king salmon.

(e) A king salmon 20 inches or greater in length that is removed from the water shall be retained and becomes a part of the bag limit of the person originally hooking it. A person may not remove a king salmon from the water before releasing the fish.

(f) In all waters except those designated as special management areas for rainbow trout in 5 AAC 61.025, bait may be used for burbot fishing only if the gear specified in (1) - (4) of this subsection is used. Burbot may be taken with more than one line and hook only if

(1) the aggregate number of hooks does not exceed the daily bag limit for burbot in the waters being fished;

(2) the hooks are single hooks with a gap between the point and the shank at least three-fourths of an inch or larger;

(3) each hook is set to rest on the bottom of the lake or stream;

(4) except in the flowing waters of the Susitna and Yentna Rivers, the angler remains with the fishing gear at all times, notwithstanding the 24-hour period provision in 5 AAC 75.033(5) ;

(5) in all flowing waters of the Susitna and Yentna Rivers, each line is closely attended by the angler as specified in 5 AAC 75.033(5) .

(g) In Sucker, Flathorn, Whiskey, Hewitt, Donkey, Three Mile, Trail, Neil, Kroto, Trapper, Figure Eight, No Name (cabin), Lower Vern, Upper Vern, and Lockwood Lakes, and Nancy Lake Recreation Area lakes, excluding Nancy Lake, five lines may be used to fish through the ice for northern pike only if

(1) repealed 3/21/99;

(2) the fishing gear is closely attended by the angler as specified in 5 AAC 75.033(5) ; and

(3) all other species of fish caught are released immediately.

(h) In the lakes specified in (g) of this section, bait may be used for fishing for northern pike if gear described in (g)(1) - (3) of this section is used.

(i) Notwithstanding 5 AAC 61.022, a person, after taking a king salmon 20 inches or greater in length, may not fish for any species of fish on the same day in the following waters open to fishing for king salmon:

(1) Ship Creek downstream from a point 100 feet downstream from the Chugach power plant dam;

(2) Caswell Creek from its mouth upstream to the Parks Highway and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(3) Montana Creek from its mouth upstream to an ADF&G regulatory marker located one-half mile upstream from the Parks Highway Bridge and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(4) Birch Creek (Birch Creek Slough), only those waters within a one-quarter mile radius of its confluence with the Susitna River;

(5) Goose Creek from its mouth upstream to the Parks Highway and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(6) Little Willow Creek from its mouth upstream to the Parks Highway and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(7) Sheep Creek from its mouth upstream to the Parks Highway and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(8) Sunshine Creek, only those waters within a one-quarter mile radius of its confluence with the Susitna River;

(9) that portion of the Susitna River, including waters within a one-quarter mile radius of its tributaries' confluences, from its confluence with the Deshka River upstream to its confluence with the Talkeetna River;

(10) Little Susitna River from its mouth upstream to the Parks Highway Bridge at Houston;

(11) Willow Creek from its mouth upstream to the Parks Highway bridge and all waters within a one-quarter mile radius of its confluence with the Susitna River;

(12) East Fork Chulitna River drainage, including all waters within a one-quarter mile radius of its confluence with the West Fork Chulitna River and the Chulitna River;

(13) Eagle River drainage;

(14) Kashwitna River drainage from its mouth upstream to the Parks Highway Bridge and all waters with a one-quarter mile radius of its confluence with the Susitna River.

(15) Eklutna Tailrace, from its confluence with the Knik River upstream to an ADF&G regulatory marker located approximately 100 feet downstream of the Old Glenn Highway, and in the waters within a one-half mile radius of its confluence with the Knik River.

(j) Notwithstanding 5 AAC 61.022, a person, after taking a king salmon 20 inches or greater in length, may not fish for king salmon in the following waters open to fishing for king salmon:

(1) Alexander Creek from its mouth upstream to an ADF&G regulatory marker located 400 yards upstream of its confluence with Trail Creek and all waters within one-half mile of its confluence with the Susitna River;

(2) Deshka River and its tributaries upstream to an ADF&G regulatory marker located adjacent to Chijuk (No-name) Creek (RM17) and all waters within a one-half mile radius of its confluence with the Susitna River;

(3) Fish Lake Creek from its mouth upstream to ADF&G regulatory markers located at the mouth of Fish Lake Creek's inlet to the first lake and all waters within a one-half mile radius of its confluence of the Yentna River;

(4) Lake Creek drainage and all waters within a one-half mile radius of its confluence with the Yentna River;

(5) Clear (Chulina) Creek from its mouth to an ADF&G regulatory marker located 2 miles upstream and all waters within a one-half mile radius of its confluence with the Talkeetna River.

(k) Northern pike may be taken by bow and arrow and spear in all lakes, except Alexander Lake. The arrow must have a barbed tip and be attached by a line to the bow. For the purposes of this section, "bow" means a long bow, recurve bow, compound bow, or crossbow.

( l ) In all lakes, two hooks may be used per line when fishing through the ice for northern pike, if both hooks are attached to the same single piece of bait.

(m) Repealed 3/13/2004.
