Section 90. Unlawful possession of herring or herring gear

5 AAC 27.090. Unlawful possession of herring or herring gear

(a) A person may not possess unprocessed herring aboard a vessel licensed as a commercial fishing vessel within any registration area unless the season is open or unless the person is acting under the authorization of 5 AAC 27.030(b) . This prohibition does not apply to herring possessed for subsistence or personal bait purposes under applicable regulations.

(b) A person may not possess herring or herring gear aboard a vessel licensed as a commercial fishing vessel within any registration area if the herring are taken in violation of, or the gear is prohibited by other regulations in this chapter governing the registration area, unless the vessel is acting under the authorization of 5 AAC 27.030(b) .

(c) It is unlawful for any person to possess, purchase, sell, barter, or transport herring within the state or within waters subject to the jurisdiction of the state if that person knows or has reason to know that that herring was taken or possessed in contravention of the regulations of this chapter.
