Section 271. Provider closing

4 AAC 65.271. Provider closing

(a) Except as provided in (b) of this section, a participating provider that either permanently or temporarily closes a facility shall provide written advance notice to participating families and to the grantee or subcontractor no fewer than 14 days before the actual closing of the facility.

(b) In the event of an unscheduled permanent or temporary closure for which the 14 days' advance notice required by (a) of this section is not possible, the provider shall either provide for alternative care for participating families or reimburse participating families for child care costs in the amount of the daily program rate paid to the provider by the grantee on behalf of the families.

(c) If, without reasonable cause as determined by the grantee, a participating family refuses alternative care arranged under (b) of this section, the family shall pay any child care costs from the time of the facility closure until either the facility reopens and again provides child care services to the family or the grantee issues a new child care authorization for a different provider.
