Section 5. Applicability

4 AAC 62.005. Applicability

(a) The provisions of this chapter apply to child care facilities licensed or required to be licensed under AS 14.37.030 (a). However, where necessary or appropriate, various specific requirements set out in this chapter apply to, in some cases, to less than all kinds of child care facilities of a particular type, depending on certain factors, such as the type or size of facility and whether the facility has any employees. Abbreviated terms such as "center", "group home", "home", or "facility" may be used to refer to the facility type, rather than the full name of the facility type.

(b) In the event of conflict between a generally applicable requirement and a specific requirement applicable to a particular type or size of child care facility, the requirement specifically applicable to the child care facility type or size applies.

(c) The requirements of this chapter apply to a child care facility

(1) during the normal business hours identified on the child care facility's license application; and

(2) any time the facility provides child care services outside the child care facility's normal business hours.
