Section 144. Extended school year

4 AAC 52.144. Extended school year

(a) Each district shall ensure that extended school year services are available as necessary to provide a FAPE if a child's IEP team determines, on an individual basis, in accordance with the requirements of 34 C.F.R. 300.309, as revised as of May 11, 1999 and adopted by reference, that the services are necessary for the provision of FAPE to the child. Extended school year services must be clearly set out in a child's IEP.

(b) As used in this section, "extended school year services" means special education and related services that are provided to a child with a disability

(1) beyond the normal school year;

(2) in accordance with the child's IEP; and

(3) at no cost to the parents of the child.
