Section 456. Hearing on expedited consideration

2 AAC 50.456. Hearing on expedited consideration

(a) A hearing on expedited consideration of a complaint alleging a violation of AS 15.13 or a regulation adopted under AS 15.13 is before the commission in its Anchorage office or other location as required in AS 44.62.410 .

(b) The commission may participate in person, by telephone, or by delegation to a hearing officer.

(c) The complainant, respondent, or commission staff may appear at the hearing telephonically and may testify, call witnesses, or present evidence in connection with the complaint. Each witness shall be sworn.

(d) The complainant, respondent, or commission staff may be represented by an attorney or authorized agent.

(e) The hearing will be recorded.

(f) The complainant has the burden to prove a violation by a preponderance of the evidence.

(g) A written brief or memorandum will not be accepted after the hearing concludes and the commission or hearing officer closes the record.

(h) No later than one day after the record closes, the commission will issue an order as provided in AS 15.13.380 .
